As of October 1, 2025, the Maryland General Assembly has enforced significant changes (via House Bill 767) to the Real Property Article. These changes place a heavier burden on landlords regarding when you notify tenants and how you handle their property.

1. The "Surprise Eviction" is Over: The New 14-Day Notice Requirement


Previously, the timeline between a court order and the Sheriff's arrival was often unclear. The new law demands strict transparency.

The New Rule: Once a Warrant of Restitution is issued, you (the landlord) must now provide the tenant with a Notice of Scheduled Eviction at least 14 days before the Sheriff’s scheduled date.

The New Law (Effective Oct 1, 2025): "Curbside" disposal is banned. Maryland law now emphasizes the "Reclamation of Personal Property."

The 10-Day Hold Rule:

  1. Secure the Belongings: You must leave the tenant's property inside the premises (or move it to secure storage).

  2. Hold for 10 Days: You must allow the tenant reasonable access to reclaim essential items for 10 days post-eviction.
